Nonprofits/Localities

One of the most important benefits of using a CalHFA loan for a homebuyer is the access it provides to down payment assistance programs, and the most important providers of down payment assistance programs are localities and non-profits.  CalHFA is eager to form partnerships with local agencies, as they can help homebuyers make informed choices about what loan is best, and what down payment assistance programs are available.  Please browse this section for more information on how CalHFA can complement your existing programs.

Affordable Housing Partnership Program (AHPP)

CalHFA partners with over 300 localities (cities, counties, housing authorities, nonprofit entities, and redevelopment agencies) to offer the Affordable Housing Partnership Program (AHPP). This program allows borrowers to combine a CalHFA first mortgage loan with down payment and/or closing cost assistance from an AHPP partner. CalHFA first mortgage program options are determined by individual AHPP partners for their respective programs. Interested in Becoming an AHPP Partner?

The Affordable Housing Partnership Program (AHPP) provides a partnership between CalHFA and localities (defined as cities, counties, housing authorities, nonprofit entities and redevelopment agencies) that will create additional affordable home ownership opportunities. Localities wishing to have their programs reviewed by CalHFA for approval must follow the procedures listed below.

Steps for obtaining CalHFA approval for loan/grant program(s):

  1. Submit copies of all loan/grant/resale control program documents that will be required to be signed by the borrower(s) at the close of escrow, such as the Note, Deed of Trust, Loan Agreement, Resale Control Agreement, etc.
  2. Submit copies of all documents referenced in or incorporated into the documents described in the previous bullet, including any previously recorded documents in which resale controls, options, etc., appear, such as Disposition and Development Agreements, Option Agreements, etc.
  3. Program documents must be emailed to Michelle Novoa-Castillo at mnovoa@calhfa.ca.gov and to Maria Jimenez at mjimenez@calhfa.ca.gov
  4. Provide contact information for the partner, such as contact name, address, phone, fax and email address.
  5. If more than one program is being submitted for review, email each program individually with the specific program's respective documents.
  6. Documents should provide adequate lender protections, including, in most cases, express language providing for subordination.
  7. Documents should provide that in the event of a foreclosure, or deed in lieu thereof that any restrictions, options, first rights of refusal, etc., terminate and are not binding on any party, as well as the successors and assigns of such party.
  8. Partners must be willing to subordinate their program(s) to CalHFA financing.
  9. Documentation will be forwarded to CalHFA's Bond Counsel and In-House Counsel. Bond counsel will review the program documents for Tax Act compliance while In-House Counsel will review program documents from a prudent lending standpoint, insuring adequate lender protections.
  10. CalHFA will require a completed, signed, original CalHFA Subordinate Financing & Resale Control Agreement for each program that receives approval. This Agreement is to be mailed to the following address prior to receiving final program approval: Attention: Michelle Novoa-Castillo, Loan Administration, Special Programs, CalHFA, PO Box 4034, Sacramento, CA 95812-4034.
  11. Please allow 6-8 weeks for review time for all programs.
  12. CalHFA will notify the partner of approval or denial of their subordinate loan/grant program(s) and/or resale controls.
  13. If approved, CalHFA will then post the locality and its program(s) on the CalHFA website as an eligible AHPP partner.
  14. Once approved, the program documents will be sent to a master servicer for review, if applicable. The master servicer(s) will review the program documents for Fannie Mae compliance.

All subordinate financing and resale controls are also subject to the approval of the applicable mortgage insurer.
